Information Collected and Why
We use your information for a variety of purposes, including but not limited to the following; We collect personal information from you necessary for us to process your order, process a refund, register you an account for the online shop, to determine how many visitors to our website to prevent fraud, comply with any legal obligations or information required by law and to comply and assist with the government and health authorities with Covid-19 contact tracing requirements.
Where possible we will give you the option to interact with us anonymously.
Information collected about you; name, contact information may include phone number and email, location, IP address, computer or network, interactions with us, order information, billing and purchase information. We may collect your personal information in order to; make amendments to our services so our customers have the best experience possible, fulfilling prizes from competitions, conducting market research and keeping you informed about any website changes as well as products and services.
Besides our staff, we may share this information, if necessary, with a third party in order to take actions connected to a purpose for collection. Providing some information is optional. If you choose not to enter your contact details when ordering over the phone or online, we will be unable to provide you with certain services. We keep your information safe by storing it in encrypted files and only allowing certain staff members access to it. We keep your information for two years at which point we securely destroy it by securely erasing all digital files.
You may update your Levitate Shop Account details at any time. You can do this by signing into your account and clicking on the edit button. You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. How your information is collected
We collect your information in various ways, these include, but are not limited to, when you; give google reviews, visit our website, register to order products online, order/purchase products online/phone/in person at mobile sites, use an eVoucher & submit any feedback or queries. Please be aware your information is collected if you interact or follow any social media of Levitate Coffee e.g. “like'' or partake in competitions on our Facebook Page or Instagram.
Correspondence via Email/Unsubscribing
To stop receiving any email correspondence from us, like great deals and other information, simply click the unsubscribe link at the bottom of the email.
Levitate Coffee strives to provide egg & dairy-free & gluten-free products, if requested by you, but traces of these may be unintentionally present in food due to the environment of the coffee/food cart. We cannot guarantee that your order will be 100% allergen-free.
Levitate Coffee strives to provide vegan products, if requested by you, but traces of meat and dairy products may be unintentionally present in food due to the environment of the coffee/food cart. We cannot guarantee that your order will be 100% free from animal products. Levitate Coffee strives to provide vegetarian/meat-free products, if requested by you, but traces of meat and dairy products may be unintentionally present in food due to the environment of the coffee/food cart. We cannot guarantee that your order will be 100% meat-free.

Levitate Coffee will not be liable for any costs, claims, damages, charges whatsoever, including medical and dental costs, if a customer has any adverse reaction (including dental damage) to a product sold at Levitate Coffee.
Internet Access/Free Wifi
Levitate Coffee has free Wifi available while on site. When using the free Wifi you agree to not; act or encourage others to act in an unlawful way, use the Wifi to send spam, partake actions that are harassing, bullying, threatening, abusive or otherwise inappropriate; use the Wifi access in any way that may affect the running of the Wifi. We recommend when using Wifi your device is protected with up-to-date antivirus software. The use of the Wifi is at your own risk and Levitate Coffee will not be responsible to you for any damages, losses, costs or expenses you may suffer because the Wifi is unavailable, does not operate as expected or causes loss or damage to any data.
Please be aware that no data protection or security measure is completely secure and we cannot guarantee the security of your information, particularly in relation to online transmission. We recommend you take care to ensure your information is protected e.g. keeping usernames and passwords to yourself. You must notify us as soon as possible after you become aware of any security breach.
Levitate Coffee’s website may be accessible through or contain connections to areas where you may be able to publicly post information, communicate with others, review products and submit media content.
Third Party Disclosure of your Information
Our gateway providers for payments are Verifone, Stripe or Paypal. If you use a Credit Card to place an order via our online shop or mobile site, your details will be passed on to our credit card processor who will receive and process your credit card details for those orders. If you use Stripe to place an order via our website your details will be received by Stripe in order to process the order. If you use PayPal to place an order via our website your details will be received by PayPal in order to process the order. If you place an order online and express interest in third party offers, products or services, we may provide and share your information with the providers of those third party offers so they can contact you directly regarding advertising and marketing. Levitate Coffee will not be held liable for any damages caused by Third Parties.
We cannot guarantee the Levitate Coffee website or online shop will be error-free or virus-free. You agree that you will not hold Levitate Coffee liable for any claim, loss, expense, or harm suffered by you or your devices as a result of using the website, online ordering and reserves the right to alter the agreed price if an incorrect price was caused by a software fault, error or malicious attack.
Payment Details/Refunds/eVouchers/Shop Ordering
All pricing of products are in New Zealand Dollars. All payments must be made using New Zealand Dollars. When purchasing onsite (face-to-face) we can accept Cash and Eftpos/Credit Card/Paywave. Please note we do not store any credit card details in face-to-face purchasing. Please be aware of Shopping Online Consumer Protection. Online shop orders can be paid using Paypal, Apple Pay, Google Pay, Credit Card or eVoucher. Your credit card details are required to process payment on our online shop but the full details are not saved once the order is processed. The details for credit cards we do hold are; Name on the card, expiry date and some digits but not all e.g. 123456******7891.
Levitate Coffee strives to achieve the Consumer Guarantees Act New Zealand requirements. We want our customers to be happy. We may refund you. If required we may ask you bank details to process a refund. This will be done via email or by post if email is not available. eVouchers are available for purchase from our online shop. eVouchers are like a digital gift card that can only be used once at our online shop via our website and are not redeemable for cash or transferable. eVouchers have an expiry date of 1 year. However if you have an eVoucher and Levitate Coffee is no longer in business, you will need to apply for a refund at email@example.com. To use an eVoucher, simply enter the code from the eVoucher at checkout. Levitate Coffee reserves the right, in its sole discretion, to cancel any eVoucher code, or refuse to honour any eVoucher code (including after it has been redeemed by the customer), if Levitate Coffee suspects that the eVoucher code has been fraudulently generated and/or circulated without Levitate Coffees authorisation. If you create an account with our online shop you may have the ability to save your preferred payment method. Levitate Coffee do not hold these personal account details, they are held by our payment gateway provider, Verifone. Please refer to our section “Third Party Disclosure of your Information'' for more information about this provider.
When ordering via our online shop please note that orders will only be fulfilled during our working hours. By using our shop you agree that Levitate Coffee will not make your order outside of hours. We have the right not to refund you if you have placed an order outside of our working hours if we believe you have done so knowingly and/or deliberately be unlawful or untruthful. You can find our work hours by following this link: https://levitatecoffee.co.nz/contact-us. Any change of hours will be updated on our website, google and/or all media sites.
SuperGold Card Members
Regarding discounts or promotions: This offer is not valid with any other promotion or discount advertised. The 20% discount will be taken off the full retail price listed. This offer is only redeemable instore when you present your SuperGold Card. Valid only while stocks last.
Order Pickup/Zero Contact Pickup
When ordering products online, we want you to pick up your order when it is hot and fresh. Please make sure you request a time to pick up your order. Pick up of orders in New Zealand Covid-19 Alert Level 3 (or lower if requested) will be of zero contact. If you have prepaid your order e.g. online there is no need to touch anything at Levitate Coffee other than your order and manual contact tracing sign in if Covid Tracer App Scanning is unavailable to you. If you have not paid for your order online and do it on site, we prefer paywave but can accept cash upon pickup if necessary. The designated pick up point for all orders in Level 3 will be the table outside The Levitate Coffee Cart.

Online Ordering Account
You are responsible for the confidentiality of your personal details, password and payment details. You acknowledge that when you access the website or login as a registered account holder, you may remain logged in to the website even after closing the internet browser (unless you log-out prior to leaving the website or erase your cookie data). If you sign into your registered account on a shared/public computer and do not sign out, someone else who uses the computer after you may be able to access your Levitate Coffee account. We recommend that you log out of all services when you have finished using a shared/public computer.
If you breach any of the Terms & Conditions or do anything else with your account that is unlawful or not allowed including, but not limited to; Access data you do not have the permission to access, breach terms, be misleading or fraudulent, infringe on someone else's rights, upload viruses or malicious code; we may choose to suspend access, cancel or ban your account. We are not required to provide you with prior notice of those actions.
If you no longer want or need your Levitate Coffee Account you may delete it by signing into your account and removing your details. If you have trouble with this please let us know.
External Online Ordering Account
You may have the option to create a Levitate Coffee account using an existing external account e.g. Facebook or Google. You acknowledge and agree that your Levitate Coffee account will only be active whilst your external account remains active and that your use of the external account is governed by the external account provider's own Terms & Conditions and Levitate Coffee will not be responsible for anything to do with your use of the external account.
The text, graphics and code contained in Levitate Coffee’s website are the property of Levitate Coffee and may not be copied, displayed or reproduced in any form or by any means without written permission from Levitate Coffee.
Levitate Coffee appreciates any feedback and complaints, it helps us grow and improve our business. If you wish to lodge a formal complaint please do so in writing to our “Contact Us” page on our website. Alternatively, if email is not an option, please send to Vicky Gallon at 86 Victoria Street, Carterton, 5713, New Zealand. You will need to provide sufficient details regarding your complaint as well as any supporting information or evidence. If you are not satisfied with our response to your complaint or think we have breached the New Zealand privacy laws, you may send your complaint to The Office of Privacy Commission via their website www.privacy.org.nz.
Levitate Coffee damages are capped at however much a customer spent on the purchase immediately before the alleged damage occurs. Levitate Coffee will not be sued for any amount above however much a customer spent on their purchase or of a reasonable amount discussed and agreed to. Levitate Coffee takes no responsibility for typos and description inaccuracies, but agrees to provide such accuracy as possible. We do not promise services or goods will always meet a customer's expectations but we will try our best in any case of course to provide high quality goods and services. We have the right to withdraw or cancel any services of Levitate Coffee as we deem necessary at any time.
